I really hope no one on here has had any accidents especially in the heavy rain.

hope the rider's ok! Take care out there peeps... FWIW I've been commuting on the CB1300 in the rain - them Dunplop Roadsmarts are pretty dang good in the wet, on the 020's I had previously I was nervous of the throttle in the wet, I'm much less so on the Dunplops (bearing in mind I vowed never to have Dunlops ever again as the OE fitment ones were so cack). In my experience, heavy rain is less of a peril grip wise than a drying road.

under normal circumstances marc i would agree but since being there her face did not fit which no secret was made of and the manageress and her croonies have made jens life a living hell even to the point of a mention on facebook stating " you just dont get the point do you...why dont you quit?" which i hasten to add was quickly deleted ( obviously under the advice of better legally informed other ) for fear of legal action.
I am extremely proud that Jen stuck it out and did not allow them to drive her out of her job and when she approached the owner of the buisness he said he could not get involved as it would undermine his manageress ( who seemed to be the instigator of the hate campaign).....that came across as him not having control of his own buisness and this now seems to me that as her 6 monthly contract is due to end he is going to take it as the easy way of putting an end to it without confronting his manageress but doesnt have the balls to tell jen face to face because he knows the real reason he is doing it . |

if she is leaving anyway and if it were me i'd be putting a letter to the owner saying that i was considering legal action over the bullying by the manageress and staff, go the the dti website and see what legal rights employees have, at the end of the day you may only get the satisfaction of putting all to paper/e-mail but you never know what might be offered to keep things quiet? _________________ 97 750 srad

Slappy/GSEX - sorry to hear about that mate. Hope she finds something else soon.
Re Gxsrboy's comment - unless her 6 month contract has been a rolling one and she's been there longer than 1-2 years and depending on the terms of termination under that contract, a scary letter may, unfortunately, be all she can do about it. Contractors have few rights if their fixed term contract has simply come to an end (unless the contract envisages automatic renewal other than in very specific circumstances), and employees of less than 1-2 years have little recourse under employment legislation.
Good on DaBitch for sticking it out through the bullying. Unfortunately however, this means she probably doesn't have a case for constructive dismissal since they didn't 'force' her to quit.
If she has been there longer than 1-2 years though, it may be worth speaking to an employment lawyer. PM me if you need some recommendations. Even better if she's also union.
Phoenix - sorry to hear about your car, babes! What happened?!?

true as that may be though regardless of whatever contract is written or implied, being bullied at work is illegal and if it were me i'd at least write and see what came of it. worth a try surely? _________________ 97 750 srad

Definitely worth speaking to an employment lawyer about, given she's been there over 12 months.
FWIW to get anything out of an employment tribunal specifically for bullying, a lot needs to be proven. That it took place (records etc), was reported, that no satisfactory action was taken by the employer, the distress and damage it caused, and you need to be clear what you want to get out of it. Reinstatement? Doubtful she'd want to work there again. Damages? Needs to be specific and quantifiable - distress, unpaid time off work etc. Unfortunately, we aren't as litigious as across the pond where people can sue for practically anything! _________________ Baby Biker Babe!

I would go for it, you have nothing to lose
It can't be a nice time now after what's happened, but, i'm sure she will find something soon. I think given time you will both look back i think this is a good thing. If she is not happy there, and she is being bullied, then she is better off 'outa there'. |
